 New trial ordered for Montana Power case May 18, 2012 editor@montanaliving.com
 District Judge Kurt Krueger has tossed out a verdict in favor of Montana Power Co. and has ordered a new trial. Kruger ordered the new trial, on knowledge that a juror had presented additional information to other jurors during the trial in which Montana Power prevailed. The 8-4 verdic was handed down in Februaryt in favor of Montana Power, helping the former utility save millions of dollars in damages. The 141 plaintiffs alleged Montana Power mishandled workers' compensation claims and employee benefits dating back to 1977. The plaintiffs' attorney is Lon Dale of Missoula; he asked for a new trial in April. |
